Submissions with respect to the draft policies implementing the duty to cooperate and the duty to maintain employment set-out in the Workers Compensation Amendment Act (No. 2), 2022 (Bill 41) (the “Draft Policy”). These are joint submissions from the BC Federation of Labour (the “Federation” the “BCFED”), the Community Legal Assistance Society (the “CLAS”), and the BCFED Workers’ Compensation.

There is a new reality in BC and many other places today: Employers can no longer count on having the upper hand, and workers aren't prepared to cede it to them. And that has opened up possibilities for working people to make important advances — not just in unionized workplaces, but throughout BC.
